UliziaNow AI - Terms of Service

1. Acceptance of Terms
By accessing or using UliziaNow AI ("Service"), you agree to be bound by these Terms of
Service. If you do not agree, you must not use the Service. These Terms incorporate our Privacy
Policy, Kenya Data Protection Act 2019 requirements, and Communications Authority of Kenya
(CAK) regulations.
2. Description of Service
UliziaNow AI is an SMS-based artificial intelligence assistant service providing question
answering, information retrieval, general knowledge assistance, and educational support
primarily through SMS (Shortcode) via Safaricom networks.
Limitations: The service does NOT provide reliable medical, legal, financial, or professional
advice and is not a substitute for professional consultation.
3. Eligibility and Registration
Minimum Age: 13 years old (Users under 18 require parental consent).
Requirements: Valid Kenyan mobile phone number and provision of accurate information.
Responsibility: You are responsible for all activities and charges incurred under your phone
number.
4. User Conduct and Acceptable Use
Users may use the service for personal information and educational purposes. Prohibited
activities include illegal acts, distribution of harmful content (CSAM, violence, hate speech),
attempting to reverse engineer the AI, and seeking professional advice (medical, legal, or
financial). Specifically in Kenya, political campaign messages are restricted to 8:00 AM - 6:00
PM.
5. SMS Communication and Costs
Charges: Standard SMS rates apply to user-initiated messages; responses may incur
standard or premium rates.
Limits: 160 characters per SMS (GSM-7 encoding).
Opt-Out: Users can opt-out anytime by sending "STOP", "CANCEL", or "TOKA" to the
shortcode.
6. Content and Intellectual Property
Users retain ownership of input messages but grant UliziaNow a license to use them to improve
the service. UliziaNow assigns ownership of AI-generated responses to the user, subject to
terms. UliziaNow AI retains all rights to its technology, algorithms, and trademarks.
7. Disclaimers and Liability
The service is provided "AS IS". To the maximum extent permitted by Kenyan law, UliziaNow AI
is not liable for indirect or consequential damages. Maximum liability is capped at KES 10,000 or
the amount paid in the preceding 3 months, whichever is lower.
8. Governing Law
Governing laws include the Constitution of Kenya, Data Protection Act No. 24 of 2019, and the
Computer Misuse and Cybercrimes Act. Disputes are subject to the exclusive jurisdiction of the
courts of Kenya.
